General Terms and Conditions

Article 1 : Object and Application

The website www.kappachan.fr is the property of the Firm KAPPACHAN registered at the Trade Register of Lille under the number 497 533 323 RCS LILLE

SARL KAPPACHAN, BP 20119, 59832 LAMBERSART cedex.

The present General Terms and Conditions apply to all sales of products sold on the website www.kappachan.fr and exclusively regulate the terms of the partnership between KAPPACHAN and the buyer. The parties except without reservation those general terms and conditions. If a condition is missing, it is considered regulated by the rules of trade as regulated by the trade laws of France. KAPPACHAN respects all rules of the code of trade as it relates to external sale.

All orders made through KAPPACHAN suppose first the lecture of those conditions and mean automatically the acceptation without reservation of the present conditions.

KAPPACHAN can change at any time and without notification the present general conditions of sale but these modifications only apply to orders made after these changes.

The present general conditions of sales are permanentlyaccessible through the website www.kappachan.fr. The buyer can also consult, print or store them at any time. The present General Terms and Conditions are aiming at establishing rights and duties of the two parties and at clarifying the modes of order, payment, delivery and possible returns of goods.

Article 2 : Products

- Conformity :

In accordance with the code of trade, each product sold on the website is associated with a description of the product ( material, size, colors, price) and illustrated with photographies to make sure that buyer know the characteristics of products before to place an order. Specifications like images, specifications and illustrations are not contractually provided. Therefore KAPPACHAN's responsability can not be committed in case of en error or omission of informations or in case of modification of elements by the supliers and/or manufacturers. Only the buyer must judge if the product he wants to order corresponds to goods he already had. Nevertheless, the buyer can write KAPPACHAN a letter or an e-mail or also phone to obtain all informations he wish before to place his order.

KAPPACHAN can change at any time and without notification the products sold on the website www.kappachan.fr but these modifications only apply to orders made after these changes.

- Prices and postal charges :

All prices on the site www.kappachan.fr are mentioned in Euro, all taxes included except shipping prices. Postal charges are extra and they are calculated according to destination, weight and value of articles which are in the parcel. Before to definitively validate the order, the buyer will be given a summary of his order which include Sale, postage and packing price.

By validating the order and making tha payment of the order, the buyer accept the postal charges with full knowledge. Postal charges can also under no circumstances be grounds for invalidation of the order. If the buyer cancels his order afer that the goods have been send, postal charges won't be paid back. Postal charges will be deducted from the repayment amount provided by KAPPACHAN and it will be made within 15 days of cancellation.

KAPPACHAN can change at any time and without notification prices in case of sales or special offers.

- Availability :

Products proposed by KAPPACHAN are sold while stocks last. The availability is specified for each product when customer add it to your cart. If a product is out of stock, customer will be given the possibility to be informed of its disponibility. Availability depends on delays of delivery imposed by suppliers. Therefore a report of delays of disponibility or a definitive non-availability can not engage KAPPACHAN's responsability or can not entitle the buyer to any compensation or damages in favour of the buyer. In case of report of delays of disponibility, KAPPACHAN will inform the buyer ( e-mail or letter) about the new delays imposed by suppliers. In case of an extended period of time in the disponibility or in case of a definitive unavailability of the product, KAPPACHAN can propose the buyer a similar product or a reimbursement in the form of vouchers or a cancellation of the order and of course the reimbursement of the order within 7 days after the decision of the buyer.

Article 3 : Order

Orders are carried out and considered fulfilled only on receipt of the bank transfer or the payment of the bill through credit card.

- Order

Each product proposed on the website www.kappachan.fr is associated with a description of the principal characteristics of the product and illustrated with few photographies. To place an order, customers have to click on the button « Add to cart » and to click again to order few articles which are added to the cart. After each added product, customer get a summary of all the products he has selected before. When the customer has finished, he clicks on the button « Order » to get a final summary of his order. At this moment, the customer has the possibility to cancel or change products but also cancel definitively the order.

If the customer's account has not been created yet, the next step is to create it by entering data and in particular delivery adress, before checking out the order. Thanks to the delivery adress, postal charges will be given and therefore the total amount of the order. With full knowledge of his order, the customer can click on the button « check out » to definitively accept the order. Then customer effects the payment of his order. The payment procedure will be processed on the secure server of the selected bank. The bank details of the customer are never under the possession of Kappachan. Their conservation and the maintaining of their integrity is a matter for the responsability of the bank. Once the payment has been validated by the secure server of the bank, Kappachan will forward a summary of the order to the customer, in particular the details of the products ordered, the total prices ( postal charges included) and the delivery time. The bill will be send in the confirmation e-mail.

- Payment and non payment

The customer attests having all authorisations necessery in order to apply the payment and guarantees his solvency before placing an order. Through lack of this, Kappachan would not send the ordered products.

If the banking establishment does not deliver the payment autorisation or if the customer is opposed to bank's effecting the transaction ( before or after the concluded transaction), Kappachan has the right to cancel the order without notification and delay and can require the customer to return goods at the expense of the customer. Even if the bank has authorised the payment, Kappachan has the right to suspend or cancel the order if the customer would have not paid a previous order yet. Kappachan will advise the customer who will have the possibility to balance his account.

Article 4 : Delivery

The delivery of the order takes place after the validation of the order and after the complete payment and it is carried out at the adress given during the order. The customer must also provide all information necessery in order to process the delivery. In the case of incorrect or incomplete shipping information that make impossible for the shipping company to deliver goods which will be returned to Kappachan. A second delivery will be effected once the costs are paid by the customer.
No parcel will be left in the postbox of the customer. A transit note will be left so that the customer can pick up the order at the local post office. If the customer refuses the delivery, the order will be refunded for the amount of the order minus the costs of shipping.
KAPPACHAN gives the delivery of the order to a shipping company, sole responsible for its terms of delivery. If the deadlines are not respected, the responsability of Kappachan can not be engaged. If the shipping company declares the order mislaid, Kappachan will refunds the order or propose to exchange the order, or to offer vouchers.

Article 5 : Time of retractation

In accordance with the French Consumer Code, the customer has the right to return an order within a time period of 7 days from its arrival without penalties excepted the return costs. The customer must return the order at his expense and responsability and in the original condition ( perfect conditions of resale, in the original packaging). If these requirements have been met, Kappachan will proceed to reimburse the order minus the costs of shipping within 15 days of the receipt of the returned goods. No reimbursement will be given if the products do not arrive perfectly intact.

KAPPACHAN does not reimburse or exchange personnalized or engraved products ( ex: ID Tag), or made to measure products, excepted the case of a default in the realisation.

Article 6 : Returns

The costs for returning goods are at the expense of the customer, except in the case of a return based on an error made by Kappachan in the preparation of the order. The customer must return the order at his expense and responsability and in the original and unused conditions ( perfect conditions of resale, in the original packaging). The shipping risks for returns are entirely the responsability of the customer returning the order. The customer is responsible for insuring the safety of the return.

Article 7 : Guarantees

In accordance with the French Consumer Code, the customer has a legal guarantee. In the case of a defective product, the customer will return goods following the conditions mentionned in the article 7 of the present General terms and Conditions. Damages caused by a misuse or an use contrary to the use informations ( including washing) are not under guarantee.

Article 8 : Personal data

In accordance with the law made 6 January 1978 and modified by the law of 6 August 2004, web users have the right to access and correct their personal data. This data is given only for the purpose of carrying out the delivery of the products ordered. They are required in order to process the order, and, if necessary, to investigate fraud. The customer is advised that refusal to provide data required make it impossible to fulfil delivery of the products he/she would like to order. The customer is further advised that in the course of verifying the data during the ordering, third parties may be used for the single purpose of verifying this information. The customer has the possibility to oppose access by third parties, except in the case of being used for checking the data needed to process the order, as it has been specified that opposition to this usage would make processing the order impossible.

Article 9 : Events beyond control – Applicable Laws

The mutual obligations resulting from these present General Conditions are subject to suspension in the case of an overriding accidental occurrence or event beyond control. These will be moderated by the courts and French tribunal. The present General Conditions are subject to French law with regard to the rules of content and form. The goal of all litigation will be the subject of an amicable attempt at settlement.
